Terms of service
These General Terms and Conditions of Sale apply to Lantmännen Functional Foods’ sales to consumers in the Lantmännen Functional Foods Online Store.
In connection with sales to consumers, the mandatory rules that apply in accordance with the Swedish Consumer Sales Act and the Swedish Distance Contracts Act are applied.
1. Definitions
1.1 For the purpose of these General Terms and Conditions of Sale, the following definitions apply.
- "Agreement" is the agreement entered into by the Parties for the Customer’s purchase of Items from Lantmännen Functional Foods in the Online Store.
- "Distance Contracts Act" refers to the Swedish Act (2005:59) on Distance Contracts and Off-Premises Contracts.
- "Online Store" refers to e-commerce store of Lantmännen Functional Foods.
- "Consumer Sales Act" refers to the Swedish Consumer Sales Act (1990:932).
- "Customer" is the consumer who enters into an Agreement with Lantmännen Functional Foods.
- "Lantmännen Functional Foods" refers to Lantmännen Functional Foods AB, Swedish corporate ID number 559199–5104.
- "Lantmännen Digital Services" refer to Lantmännen’s platform for digital services.
- "Party" is either the Customer or Lantmännen Functional Foods.
- "Parties" refer to the Customer and Lantmännen Functional Foods collectively.
- "Item" or "Items" refer to the item or items covered by the Agreement.
- "Terms and Conditions" are these General Terms and Conditions of Sale, which form an integral part of the Agreement.
2. Order and Order Confirmation
2.1 By completing a purchase in the Online Store, the Customer enters into an Agreement with Lantmännen Functional Foods.
2.2 In connection with such purchase, Lantmännen Functional Foods sends an order confirmation to the e-mail address provided by the Customer.
3. Product Range and Product Information
The product range shown in the Online Store may differ from the Lantmännen Functional Foods product range that is sold in physical stores and may also vary depending on whether the Customer is shopping as a guest or as a logged in user. Prices and other information are provided subject to final sale of the product and any image, price, and text errors. Photos and images of Items that appear in the Online Store are illustrations only. The actual appearance, functions, and quantities of the Items may differ from these illustrations. Lantmännen Functional Foods cannot be held responsible for information provided by third parties, unless otherwise follows from mandatory legislation.
4. Prices and Fees
4.1 Prices shown in the Online Store are stated in Swedish kronor (SEK) or EURO, inclusive of VAT, and are updated regularly. Price adjustments may take place without prior notification due to, for example, changes in exchange rates, taxes, or fees, or due to price changes from suppliers. The price stated in the shopping cart at the time of purchase is the price that applies.
4.2 All prices are always stated exclusive of shipping fees and any other additional fees. The shipping cost of the selected delivery method and such additional fees are specified at check-out before completing the purchase.
5. Promotions and Offers
5.1 Various promotional offers may be made by Lantmännen Functional Foods. The scope of and other conditions for such promotional offers are determined separately by Lantmännen Functional Foods. Lantmännen Functional Foods reserves the right to terminate a promotional offer prematurely. Discount codes and the like that are offered by Lantmännen Functional Foods have no cash value and cannot be redeemed for cash, credits, or the like.
6. Payment and Retention of Title
6.1 Payments can be made by debit or credit card or through payment services, such as Klarna. Lantmännen Functional Foods reserves the right not to always offer all payment options. Payments can be made in Swedish kronor (SEK), inclusive of VAT, or in euro (EUR) for international sales, inclusive of the relevant country’s applicable VAT.
6.2 The Item is owned by Lantmännen Functional Foods until paid.
Debit and credit cards
6.3 Debit and credit cards issued by VISA or Mastercard can be used for payment. Card number, personal ID number, CVC code, and card expiration date must be provided. In addition, current security requirements may require that additional measures be taken by the Customer for the payment to be executed. Lantmännen Functional Foods reserves the right to verify the validity of the card, availability of funds for the purchase, and the Customer’s address details. Lantmännen Functional Foods may refuse the purchase as a result of such verification procedures. The Customer’s account is charged at the time of purchase. Card payments are handled via Shopify Payments.
7. Delivery and Shipping
7.1 Delivery can take place within Sweden and the EU. Further information and terms of delivery and shipping can be found under Terms of Delivery.
7.2 For questions about delivery lead times, the Customer can contact the Lantmännen Functional Foods Customer Service.
7.3 Orders of Items from Lantmännen Functional Foods that are in stock and that are placed on a weekday before the cut-off time of the respective shipping method, as specified below, will be sent by Lantmännen Functional Foods the same day. If the Item in stock is ordered from Lantmännen Functional Foods on a weekend or public holiday, the Item will be sent no later than the next weekday. If the selected delivery method cannot be used, Lantmännen Functional Foods will offer the Customer an alternative delivery method. Lantmännen Functional Foods reserves the right not to always offer all delivery methods.
7.4 An Item that is out of stock can be ordered once Lantmännen Functional Foods has it back in stock.
7.5 Collection at post office service points: Free shipping on orders over SEK 500 or the equivalent value in EURO (value of Item including VAT). For orders under SEK 500 or the equivalent value in EURO (value of Item including VAT), a shipping fee will be added and will be specified at check-out.
Items that Lantmännen Functional Foods has in stock, and which are ordered before 11:00 (11 am), are shipped within 1–3 working days.
7.6 For non-collected shipments, the Customer will be charged the costs incurred by Lantmännen Functional foods, but not less than SEK 200 or the equivalent value in EURO.
8. Right of Withdrawal
8.1 The Distance Contracts Act is applicable to the Customer’s purchase in the Online Store. The Customer has the right to cancel the purchase, without providing any reason, within fourteen (14) days. However, the right of withdrawal does not apply to purchases relating to an Item (a) for which the price depends on such fluctuations in the market that Lantmännen Functional Foods cannot affect and which may occur during the withdrawal period, (b) that can quickly deteriorate or become too old, or (c) that, with a broken seal, cannot be appropriately returned due to health or hygiene reasons and where such seal has been broken by the Customer. In addition, the Distance Contracts Act specifies certain additional cases in which the right of withdrawal does not apply.
8.2 The right of withdrawal expires fourteen (14) days from the day when the Customer or any third party specified by the Customer, but not the shipping company, takes the Item into physical possession.
8.3 If the Item is covered by the right of withdrawal, the Customer must send a clearly worded notification of the Customer’s decision to cancel the purchase (for example, a letter sent by e-mail). The Customer may, but is not required to, use Lantmännen Functional Foods’ standard form available in the Lantmännen Functional Foods Online Store or the form provided by the Swedish Consumer Agency (see konsumentverket.se). The address and other contact details of Lantmännen Functional Foods are specified below in these Terms and Conditions, please see Section 18.
8.4 In order for the Customer to exercise their right of withdrawal in time, it is sufficient for the Customer to submit the notification of their intent to exercise the right of withdrawal before the expiration of the withdrawal period.
8.5 The Customer must return the Item to Lantmännen Functional Foods without undue delay and in any case no later than fourteen (14) days from the day when the Customer notified Lantmännen Functional Foods of their decision to cancel the purchase. The withdrawal period shall be considered complied with if the Customer returns the Item before the expiration of such fourteen-day period.
Effect of exercising the right of withdrawal
8.6 If the Customer cancels the purchase, Lantmännen Functional Foods will refund all payments received by Lantmännen Functional Foods from the Customer regarding such purchase, including shipping costs (but not including additional shipping costs that are the result of the Customer selecting a delivery method other than Lantmännen Functional Foods’ standard delivery method). The refund will be made without undue delay and in any case no later than fourteen (14) days from the day when Lantmännen Functional Foods was notified of the Customer’s decision to cancel the purchase. Lantmännen Functional Foods may, however, wait with the refund until Lantmännen Functional Foods has received the Item back from the Customer or until the Customer has submitted proof of the Item having been returned. Lantmännen Functional Foods will use the same payment method for the refund as the Customer selected for the initial business transaction, unless otherwise expressly agreed between the Customer and Lantmännen Functional Foods. In any case, the refund will not cost the Customer anything.
8.7 The Customer is responsible for the direct costs for returning the Item.
8.8 The Customer is responsible for and shall compensate Lantmännen Functional Foods for an Item’s reduced value as a result of other handling than what is necessary to determine the nature, properties, and functionality of such Item. If such liability to pay compensation exists, Lantmännen Functional Foods has the right to make a deduction corresponding to the reduction in value when making the refund in accordance with the above, or to demand compensation from the Customer separately.
9. Warranty
9.1 Warranties on Items are provided by the respective manufacturer or distributor of the Items. Lantmännen Functional Foods provides no additional warranties in addition to such warranties. For more information about the warranty of a specific Item, the Customer can contact Lantmännen Functional Foods Customer Service.
10. Complaints
10.1 The Customer may not claim that the Item is defective if the Customer does not notify Lantmännen Functional Foods about the defect within a reasonable period of time after the Customer noticed or should have noticed the defect (complaint). Notifications submitted within two (2) months after the Customer has noticed the defect shall always be deemed to have been submitted in time. However, the Customer loses the right to claim the defect if the Customer does not make a complaint within three (3) years after the Customer received the Item, unless otherwise follows from a warranty or similar commitment. In connection with a complaint, it is the Customer’s responsibility to verify that the Item is purchased from Lantmännen Functional Foods in the Online Store by presenting the original delivery document or equivalent issued by Lantmännen Functional Foods.
10.2 Lantmännen Functional Foods’ address details for complaints are set out below in Section 18.
10.3 Lantmännen Functional Foods reserves the right to refuse a complaint if the Item is found not to be defective and, in such cases, to charge the Customer a reasonable fee for troubleshooting and for the cost of returning the Item to the Customer.
11. Liability for Defects
11.1 Once the Item is returned and the complaint is approved, Lantmännen Functional Foods will compensate the Customer in accordance with the rules of the Consumer Sales Act. Additional rights for the Customer may follow from the manufacturer’s or distributor’s warranties.
12. Limitation of Liability
12.1 Lantmännen Functional Foods is not liable for indirect damages or losses or for consequential damages or losses. However, this limitation of liability does not apply in the event that otherwise follows from mandatory legislation, such as the Consumer Sales Act.
13. Personal Data Processing
13.1 Lantmännen Functional Foods processes personal data in accordance with applicable data protection legislation. Lantmännen Functional Foods is the controller of such processing. To the extent that the Customer is a private individual or sole proprietor, Lantmännen Functional Foods is obliged, in accordance with applicable data protection legislation, to inform about the personal data processing that takes place under these Terms and Conditions. If the Customer is a company with employees, the Customer is responsible for providing its employees with such information. Personal data that is processed under the Agreement includes name, address, phone number, e-mail address, personal ID number, corporate ID number, company name, customer number, as well as purchase history, payment, and invoicing details. Lantmännen Functional Foods processes the Customer’s personal data for the following purposes:
- For the fulfilment of its Agreement with the Customer;
- For the fulfilment of Lantmännen Functional Foods’ legal obligations;
- To inform the Customer about Lantmännen Functional Foods’ services and changes to these Terms and Conditions;
- For marketing purposes, including e-mail and SMS/MMS marketing about Lantmännen Functional Foods, its Group companies, and Lantmännen’s partners. If the Customer no longer wants to receive such marketing, please contact Lantmännen Functional Foods using the contact details below. Direct marketing can to some extent be adapted based on a few parameters coordinated from different sources;
- To provide, maintain, test, improve, and develop the technical platforms in which Lantmännen Functional Foods are offered; and
- To produce (anonymised) statistics.
13.2 The Customer’s personal data is processed in order for Lantmännen Functional Foods to fulfil its obligations in accordance with its agreement with the Customer, or because Lantmännen Functional Foods has a legitimate interest in processing such personal data that outweighs the Customer’s interest in not having the personal data processed. Lantmännen Functional Foods never discloses personal data to third parties outside of the Lantmännen Group, except as required by law, regulation, or government decision. Furthermore, in some cases, Lantmännen Functional Foods uses IT providers and other processors that may have access to the Group’s IT environments from third countries outside the EU/EEA. Companies that process personal data on behalf of Lantmännen Functional Foods must always sign a personal data agreement with Lantmännen Functional Foods. With regard to providers outside the EU/EEA, special protection measures are taken, including signing agreements that include standardised model clauses issued by the EU Commission.
13.3 Under applicable data protection legislation, the Customer has the right, in certain circumstances, to access to and rectification of personal data, to object to the processing of personal data, to restrict processing, and to data portability. The Customer also has the right to submit a complaint to the Swedish Authority for Privacy Protection at any time should the Customer feel that the personal data is being processed in violation of applicable data protection legislation. 14. Intellectual property rights
14.1 The Online Store content is owned by Lantmännen Functional Foods or third parties and is protected by Swedish and international law. All rights reserved. Unauthorised use or distribution of the Online Store content may violate copyright law, trademark law, and/or other Swedish or international law, and may be subject to legal action. The Online Store content may not be altered, transmitted, reproduced, published, licensed, transferred, or sold without prior written permission from Lantmännen Functional Foods or other rights holders.
15. Other
15.1 Lantmännen Functional Foods reserves the right to amend these Terms and Conditions as needed. The Terms and Conditions available in the Online Store at the time when the Customer completes the purchase shall apply.
15.2 Lantmännen Functional Foods cannot be held liable for inconvenience or damage due to circumstances beyond Lantmännen Functional Foods’ control (force majeure). Unless otherwise can be indicated, war, acts of war, mobilisation, or general conscription, civil war, fire, flood, and comparable circumstances shall be deemed attributable to force majeure.
16. Applicable Law and Disputes
16.1 Swedish law shall apply to the Agreement.
16.2 In the event of a dispute, the Customer may contact the Swedish National Board for Consumer Disputes (ARN) to complain. The Swedish National Board for Consumer Disputes is an alternative dispute resolution body that can be reached at the following address: Allmänna Reklamationsnämnden, Box 174, 101 23 Stockholm, Sweden, arn.se. Lantmännen Functional Foods will respect the decision of the Swedish National Board for Consumer Disputes. The Customer may also contact the European Online Dispute Resolution (ODR) platform via ec.europa.eu/consumers/odr/.
